Terms of Service for Protagonist

Agreement to Terms

By downloading, installing, or using the Protagonist mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

Protagonist is a life journaling application for iOS devices that helps users:

  • Log daily life as Episodes with titles, descriptions, mood ratings, and tags
  • Organise life into Seasons (years) and build a structured archive
  • Track mood trends, streaks, and personal statistics
  • Generate Season Wrapped recaps at the end of each season
  • Export episodes as cinematic share cards or full season recaps
  • Export data as PDF season books, CSV, or JSON backups
  • Optionally sync data across devices via iCloud

Eligibility

Age Requirements

You must meet the minimum age requirement for your region:

  • European Union: You must be at least 16 years old (or the minimum age required in your country under local law)
  • Other regions: You must be at least 13 years old

If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App.

Capacity to Agree

By using the App, you represent and warrant that:

  • You meet the age requirement for your region
  • You have the legal capacity to enter into a binding contract
  • You have the right, authority, and capacity to enter into these Terms
  • You will use the App in compliance with these Terms and all applicable laws

License to Use

Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your iOS device(s)
  • Use the App for your personal, non-commercial purposes
  • Access and use the App’s features and functionality

Restrictions

You agree NOT to:

  • Copy, modify, adapt, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the App for any illegal, unauthorized, or commercial purpose
  • Attempt to gain unauthorized access to any portion of the App or its systems
  • Use the App in any way that could damage, disable, overburden, or impair the App
  • Resell, rent, lease, sublicense, or distribute the App
  • Use the App to violate any applicable laws or regulations

User-Generated Content

Your Data

You retain all ownership rights to the episodes, seasons, mood data, notes, and other content you create in the App (“User Content”).

By using the App, you grant us a limited license to:

  • Store your User Content locally on your device
  • Sync your User Content via iCloud (if you enable this feature)
  • Process your User Content to provide App functionality (calculate streaks, mood trends, Season Wrapped, etc.)

This license is:

  • Non-exclusive (you can use your data elsewhere)
  • Limited to providing App functionality
  • Revocable (by deleting the App or your data)

Responsibility for Your Content

You are solely responsible for:

  • The accuracy, legality, and appropriateness of your User Content
  • Backing up your data (we recommend using the export feature regularly)
  • Any consequences of sharing your episodes or season recaps with others
  • Any loss of your data

We are not responsible for:

  • Loss of data due to device failure, App deletion, iOS updates, or other causes
  • Backing up your data on our behalf
  • Recovering deleted episodes or seasons
  • The content of your User Content

Subscriptions and Payments

In-App Purchases

Protagonist offers optional premium features (“Director’s Cut”) through in-app purchases:

  • Free Features: Core episode logging and season tracking is available for free
  • Director’s Cut: Advanced features including All Past Seasons, Deep Stats, Season Themes, Premium Share Cards, Smart Reminders, Export, and Hidden Episodes
  • Pricing: Monthly ($3.99), Annual ($24.99), or Lifetime ($59.99) — current prices are displayed in the App and App Store
  • Currency: Prices are shown in your local currency

Billing and Payment Processing

  • All purchases are processed through Apple’s App Store
  • Billing is handled entirely by Apple Inc.
  • You are subject to Apple’s payment terms and policies
  • We do not collect, process, or store your payment information
  • Payment disputes should be directed to Apple Support

Subscriptions

If you purchase a monthly or annual subscription:

  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled
  • Cancellation: You can cancel anytime through your App Store account settings (Settings → [Your Name] → Subscriptions)
  • Cancellation Effect: Cancellation takes effect at the end of the current billing period
  • No Partial Refunds: Cancelling does not provide a refund for the current billing period
  • Price Changes: We reserve the right to change subscription pricing with at least 30 days’ notice

Lifetime Purchase

The Lifetime option is a one-time non-consumable purchase that provides permanent access to Director’s Cut features for the current App version.

Free Trials

If we offer a free trial period:

  • You must cancel before the trial period ends to avoid being charged
  • Only one free trial per user/account
  • Trial availability may vary by region

Refunds

Refund requests should be directed to Apple, as they process all payments:

  • Contact Apple Support for refund requests
  • Refunds are subject to Apple’s refund policy
  • We cannot process refunds directly

European Union Consumer Rights

If you are located in the European Union, you have additional rights under EU consumer protection law:

Right of Withdrawal (14-Day Cooling-Off Period)

For digital content purchases (including subscriptions), you have the right to withdraw from your purchase within 14 days from the date of purchase, UNLESS you have already started using the premium features and explicitly agreed to immediate access.

Refunds for EU Consumers

EU consumers may be entitled to refunds under EU consumer protection law. To request a refund, contact Apple Support first. If unresolved, contact us at osanuo.studio@gmail.com or use the EU Online Dispute Resolution platform.

Mandatory Consumer Rights

Nothing in these Terms affects your mandatory consumer rights under EU law.

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains what data we collect, how we use it, and your rights.

The Privacy Policy is incorporated into these Terms by reference.

Intellectual Property

The App, including all content, features, functionality, design, text, graphics, logos, and the “Protagonist” name and branding, is owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not use our trademarks without our prior written permission.

Feedback

If you provide feedback or suggestions about the App, we may use your feedback without any obligation to you. We grant no compensation for feedback provided.

Disclaimers and Limitations of Liability

“As Is” Basis

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED OPERATION.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING FROM YOUR USE OR INABILITY TO USE THE APP.

For EU Users: This limitation does not apply to death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under EU consumer protection law.

Maximum Liability: To the extent permitted by law, our total liability shall not exceed the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) €100.

Data Loss

We strongly recommend regularly exporting your data using the built-in PDF, CSV, or JSON export features. We are not responsible for data loss from any cause.

Changes to the App and Terms

We reserve the right to modify, update, or discontinue the App or these Terms at any time. We will notify you of material changes through the App. Continued use after changes constitutes acceptance. EU users will receive 30 days’ notice for material changes.

Termination

You may stop using the App at any time by deleting it from your device and cancelling any active subscriptions. We may terminate your access if you violate these Terms. Upon termination, your license ends immediately.

Dispute Resolution

Governing Law

These Terms are governed by the laws of Poland and applicable EU regulations. EU consumer protection law prevails in case of conflict.

Jurisdiction

EU users may bring proceedings in their country of residence or in Poland. Non-EU users submit to the exclusive jurisdiction of courts in Warsaw, Poland.

EU Online Dispute Resolution

EU consumers may use the European Commission’s ODR platform:

Third-Party Services

The App is distributed through Apple’s App Store. Apple is a third-party beneficiary of these Terms. These Terms are between you and us, not Apple. Apple has no obligation to provide support for the App.

By using Protagonist, you agree to these Terms. If you don’t agree, please don’t use the App.

These Terms of Service are effective as of March 1, 2026 and comply with Polish law, EU regulations, and applicable consumer protection laws.
